Modern crofts are often set up on lands that were once large estates, and the modern Scots government is committed to restoring the land to the people, so it has the ambition to break up the majority of large estates. Before the eighteenth century Clanlands were held by the chief as payment for military service, and a clansman who was on military service had his lands protected If he died on service his family was protected. But then the 1745 rebellion led to lands of rebel chiefs being confiscated and when they were returned the lands were given to the chiefs as personal possessions, and the remaining clan chiefs often sold them to businessmen in the other parts of Britain. This created dispossession, which occurred with great cruelty. There was forcible emigration in some cases. Many North Americans and Canadians are descended from dispossessed Scots

Are the crofts available through the Crofting Commission from the big-landowner lands acquired through the Highland Clearances or from donations or through legacies of landowners who attempt to arighten the Highland Clearances?

Most crofts have a house on site, but this is not an iron rule. There are rules about building new build houses on crofts. I do not know what these rules are
