In case the owner doesn't pay, then they default on the loan and the lender like a bank may claim the property as payment.

This is the only state with Napoleonic code for law, and things here can differ from the rest of the country. But, one thing here is mineral rights are often retained by a seller in a transaction. One rarely gets mineral rights with property unless it is deliberately included.
